Is Wal-Mart closing stores for "repairs," or to punish activist workers?


THE REAL REASON WALMART IS CLOSING STORES SUDDENLY

It"s certainly possible that the reason Wal-Mart is temporarily closing five of its stores, including onein Pico Rivera is "ongoing plumbing issues that will require extensive repairs," as it claims.

It"s possible that the Pico Rivera closing, which will cost the jobs of more than 500 employees and will last six months to a year,isn"t part of an effort to punish workers who who have been at "the center of concerted action by associates to improve the wages and working conditions of all Walmart associates around the country," as the workers asserted in a complaint filed Mondaywith the National Labor Relations Board.

If so, however, there wouldn"t be so many questions about Wal-Mart"s repair plans. One wouldn"t have to wonder why the giant retailer hasn"t applied for building permits for the work. Not at Pico Rivera, nor(accordingto inquiries by a Tampa TV station) at any of the other four--two in Texas and one each in Florida and Oklahoma.

One wouldn"t have to ask why, of the list of 50 "plumbing issues" Wal-Mart provided to The Times dating back to July 2014 for the Pico Rivera store, half were identifiedas "non-emergency" and involvedproblems such asleaky urinalsandbroken toilet handles.

One wouldn"t have to ask why such problems hadn"t beenfixed when the store underwent a $500,000 refurbishment over the last year, during which it didn"t have to be closed--a refurbishment that included the restrooms and the grocery department, according to papers on file with the Pico Rivera building department.

Or why, if the plumbing problems were so severe that the building has to be completely shuttereduntilChristmas and possibly beyond, why Wal-Mart didn"t say anything about it until April 13. On that day, according to Venanzi Luna, an employee at the Pico Rivera store, managers called workersto a meeting at 1 p.m. to inform them the location would be closedas of 7 p.m.

The other stores were closed with similar speed. No advance warning to the customer base, to the communities, or to the employees.

Back in February, Wal-Mart made a high-profile bidto turn around its reputation for scandalously poor wages and working conditions for many of its 1.4 million U.S. workers. The company said it would raise minimum starting pay to $9 an hour beginning next monthand $10 an hour as of February 2016.

But its handling of the store closings, which will affect 2,200 workers overall, supports speculation that the February wage initiative was just for show--that Wal-Mart"s solicitude for its immense workforce is barelyskin-deep.

Luna, 36, who is a leader in the movement for better pay and conditions for employees, says the Pico Rivera staff were told that they could apply for positions at other area stores. There were noguarantees, however, that any jobs would beavailable, much less jobs at the same pay and classification they had at Pico Rivera. The workerswere told that once the Pico Rivera store reopened, they would have to reapply for jobs, andthat regardless of their job level and pay on the shutdown date, itmight be at minimum wage.

"That"s standard for our HR [human resources] procedures," Wal-Mart spokesman Brian Nick told me. Theworkers are entitled to60 days"severance, he said. But that"s not by Wal-Mart"s choice; it"s mandated by federal and California state laws, which say that workers must be given 60 days" notice of a mass layoff, or be paid for that period.

The Pico Rivera workers assert in their NLRB complaint that the four other store closings are just a smokescreen to conceal thatthey"re the company"s real target. Pico Rivera, after all, has been a hotbed of Wal-Mart employee activism through the nationwide group OUR Walmart (an acronym for "Organization United for Respect"). "This unprecedented "closure" to fix"plumbing" is part of Walmart"s overall national strategy to punish associates who stand up and speak out for better working conditions," they said in the complaint.

They note that thePico Rivera store was the site of the first OUR Walmart strike in 2012 and remained a center of vocal activismon"issues of scheduling, pay, benefits, part-time work, unfair treatment and discrimination throughout the country." They"re asking the NLRB to order Wal-Mart to find jobs for the 2,200 laid-off workers without loss of pay, orto reinstate them at their old stores.

The organization Making Change at Walmart, which is associated with the United Food and Commercial Workers union, observesfurther that Wal-Mart has been accused of anti-union maneuvers in the past. The Supreme Court of Canada ruled last year that the company had illegally closed a Quebec store in 2005 after the workers had filed to unionize; the companydenied the shutdown was related to the union campaign. In 2000, after meat cutters at a Texas supercenter voted to join the UFCW, the company announced it would close meat-cutting operations in 180 stores and switch to prepackaged meats, a move that "shows the extent to which Wal-Mart will go to keep the union out of its stores," the UFCW said.

Wal-Mart"s Nick says the recent closings were done abruptlyso that the work could get underway promptly, and that building permits haven"t yet been sought because the scope of work hasn"t been set.

But he maintained that the five closed stores had the largest number of repairworkorders in the company, andthatthe work is urgent. In January, the Pico Rivera store"s deli department was downgraded from an A to B by the Los Angeles County Department of Public Health because it had no hot water. Luna, who had worked at the store for eight years and was earning $14.40 an hour as a deli department manager, said that had nothing to do witha plumbing problem but resulted from a malfunctioning hot water heater. The downgrade happened, she said, because store managers weren"t on site to get the heaterfixed before the county"s deadline.

Nick acknowledged that the store did undergo remodeling, but added, "that"s why the recurring plumbing reports are particularly problematic." Citydocuments show that much of the refurbishmentwas completed, inspected and approved by the city before the end of December.

The Latest: Burkina Faso says 2 Australians kidnapped


Burkina Faso: Hostage situation ongoing as gunmen storm Ouagadougou hotel

OUAGADOUGOU, Burkina Faso (AP) The latest developments in the assault of a hotel by al-Qaida-linked gunmen in Burkina Faso"s capital. All times are local:

4:40 p.m.

Burkina Faso"s Minister of Security and Internal Affairs Simon Compaore says that the two foreigners kidnapped in the country"s north are Australian, not Austrian as the ministry"s spokeswoman had announced earlier. The Australian doctor and his wife who were kidnapped were abducted in Djibo, the capital of the northern Soum province. A journalist in the region said the Australian couple has lived there since 1972, volunteering in health services.

4:15 p.m.

French President Francois Hollande confirmed that French special forces helped to end the attack on a hotel in Burkina Faso in which 23 people were killed as well as the four attackers. The French Foreign Ministry said forensic officers and medical teams are working at the site.

Hollande said that the extremists were trying to attack "our life, our spirit, our trust in the future, our hope that we represent a just and democratic society. We must continue, continue to live, to act, to raise our hope, notably for future generations."

3:45 p.m.

Britain"s Foreign Secretary Philip Hammond condemned the attack by Islamic extremists in Burkina Faso"s capital in which 23 people were killed as well as four jihadist attackers. In a statement Hammond said the attack was "appalling" and said the United Kingdom "stands with President Kabore and the people of Burkina Faso in the fight against terrorism."

Hammond also advised British nationals in Burkina Faso to avoid the area where the attack took place and to follow travel advice offered by the British government.

Norway"s foreign minister says the purpose of the deadly assault of a hotel by al-Qaida-linked gunmen in Burkina Faso"s capital "apparently is to weaken the democratic process in the country."

In a statement to Norway"s news agency NTB, Borge Brende said Saturday the "vulnerable" West African country has "just gotten its first democratically elected government." Brende said "it is important that the positive development we recently have seen continues" so Burkina Faso can "progress in the right direction."

At least 23 people have been killed, as well as four extremist attackers, when a deadly assault was launched on a hotel in the capital, Ouagadougou.

Denmark"s Foreign Minister Kristian Jensen says Denmark will assess "with international partners" if it is safe for Denmark"s Australian-born Crown Princess Mary and himself to travel to Burkina Faso later this month on an official visit.

Jensen says they will not travel "if there is a situation where we cannot guarantee the security of the crown princess."

He spoke Saturday after the deadly assault of a hotel by al-Qaida-linked gunmen in Ouagadougou. At least 23 people have been killed, as well as four extremist attackers.

The 43-year-old crown princess and Jensen are scheduled to travel to the West African country Jan. 24-26, to see firsthand the situation for women"s rights and health, and Burkina Faso"s democratic situation.

Also Saturday, Denmark"s foreign ministry updated its travel advisory to warn Danes in Burkina Faso to stay away from public places.

In a separate development, Abi Ouattara, spokeswoman for Burkina Faso"s ministry of security and internal affairs, says an Austrian doctor and his wife were kidnapped by extremists in the country"s north near its border with Mali.

The spokeswoman said the jihadists abducted the two from the town of Baraboule in the Soum province in Burkina Faso"s Sahel region.

The ministry did not have immediate information on how long the two had been in northern Burkina Faso, where they were doing volunteer work.

Yesterday, she stopped by Refinery29 to discuss her dynamite 2016, how Jon Stewart was actually the deciding factor in her signing on to play Detective Maya Cruz in Ride Along 2, and more.What drew you to playing a no-nonsense Miami detective?I was excited to be able to work with Kevin Hart and Ice Cube. I was finishing the last season of The Newsroom and it didnt look like it would fit in my schedule, but after I hung out with Kevin Hart backstage at an awards show, we just instantly connected, laughing and everything.

Was it a weird transition to go from serious drama on The Newsroom to Ride Along 2?

It was strange, specifically [to go from] The Newsroom, which is, like, word-perfect, to improv-ing and stuff on Ride Along. I actually wasn"t sure if it was something I should be doing next, and then I asked Jon Stewart, who I go to for advice. The first thing he said was, Kevin Hart is an amazing human being. You dont always have to do Sorkin and Soderbergh. Go have fun with these guys. I was like, Okay! That was a big catalyst for me to do the movie.

Was the training for Ride Along 2 anything like X-Men: Apocalypse training?

[F]or Ride Along 2, I did gun training so I could learn how to use a gun and feel confident and safe with it, but then when I started X-Men like a year later, that was completely different. Doing X-Men, I started at one weight, and then by the end, I was 12 pounds lighter than when I started. I was doing six or seven hours a day of tae kwon do.Youve talked about how your Psylocke costume is sexy, but it also makes you feel like a badass. Can you elaborate?Its not so much that the costume is sexy, its that the character of Psylocke in all the comic books was drawn in a way that her costume is more revealing. But the thing that I always loved about Psylocke is that even though she was drawn a certain way, she always had substantive plotlines, so it didnt really matter what she was wearing.

"She was always one of the most lethal characters in all of the X-Men universe, and she has what Ive always thought to be the most coveted power. Shes telekinetic and telepathic. She has the ability to create anything with her mind and she can also read everyones mind. Ive always loved that about the character. Her costume was given to her by somebody else somebody else created that for her. So its not her choice and it didnt matter to her, like it doesnt matter how you see me or what I have to wear. Whats always mattered for Psylocke, I think, is how strong she is, how smart she is, how lethal she is...what she looked like had no bearing on how strong she was.What was it like working with man of the moment Oscar Isaac, who plays Apocalypse?Oh my gosh, Oscar. Im so happy for him. With the Golden Globe, I was so excited. Hes the nicest and the best. Hes a real-deal actor, but was also so fun to hang out with when we were shooting. I brought a bunch of [board] games to Montreal [where the movie filmed], so we do game night. His family and his brother and his dad would come up and visit us in Montreal, and wed all do game night. His girlfriend is so sweet.Whats your favorite board game?"My favorite board game is Taboo, the game of unspeakable fun, but Ive been playing this game called Aggravation with my boyfriend. Its kind of like the game of Sorry, but a little bit different. I make [Aaron] play it with me all the time. He just beats me every time. Thats my new favorite, Aggravation, because hes so good at it. "Thats what as actors, as artists, as entertainers, we do need the audience to want to see or hear you. Im aware of maybe things that people have thought of, I guess, but what people think of me now, I dont know. You only think back on it in retrospect. Anybody who cares too much or actively seeks out what other people think, theyre going to be living half a life, because you can never truly just be yourself.In the pressroom at the Golden Globes, Oscar Isaac also mentioned that its not just the audience, but also casting directors who have trouble seeing certain actors for some roles. Has this been your experience as well?100%. There was a time when Id go out for stuff and theyd say, Youre too Asian for this role. And then itd be like, Youre too white for this role. I remember somebody saying, Well, maybe if you just keep working hard, one day, it wont matter what your ethnicity is. White people get to play minorities all the time, but minorities cant just play the character. It has to be like, Oh, were looking for... or We already have this minority. Almost like theyve already kind of logged up, like they have two people [of color] already.

"The door doesnt swing both ways. I think that if you treat the audience like theyre smart enough, youll see that people want smart movies. They want interesting films; they want diversity. The people who are more scared of it are the people who are making the decisions, not the people that are watching it.Is that why youre getting involved behind the camera? How is the pilot youre producing about a 1970s female sportscaster going?Its my production companys first show that we sold. I wont be starring in it we have to find the cast but Im really excited about that. I sold that show and I just sold a comedy. One of the first things I did when I got the production company with CBS Studios was go to back to my friends from G4, producers and writers who I know are so talented and creative, but just have never had that opportunity and that door open for them in that way. I know how genius and brilliant they are because they helped give me my entire career.

"For me, its going back to the people who I know are the same as [I was]. Jon Stewarts the one who gave me an opportunity. I was on G4, but to make another transition, I didnt know where that would come from, and Jon Stewart [came] out of nowhere. When those opportunities come, youre so grateful. And so when I got this, I just knew I had to go back and open the door for them, and say, Whatever you have, I 100% back you, because those people, theyre so smart.

Between your behind-the-scenes projects, Ride Along 2, and X-Men, do you think your life is going to change drastically this year?

No, it wont. You never know until after the fact and you look back on it, but no. I dont think thats going to happen.But your mom had to text you about false engagement rumors! Thats big time.My mom has always been in everybodys business in our family. Shed text you right now if she knew your number and ask things about your life. Shes very invested in everyones lives.

Weezers co-headlining tour with Panic! At the Disco is headed to Phoenix with Andrew McMahon In The Wilderness opening. The show is Tuesday, Aug. 2 at Ak-Chin Pavilion.

The tour is in support of Weezers fourth yes, fourth! self-titled album and Panic! At The Disco Death Of A Bachelor.

Weezer"s self-titled debut, aka The Blue Album, became the unlikeliest modern-rock radio staple of the early "90s, fueled by Rivers Cuomo"s cult of nerdy personality, sing-along hooks and a blanket of fuzz. The first of four self-titled Weezer albums, it sold more than 3 million copies, largely on the strength of three great videos: "Undone The Sweater Song," the "Happy Days"-themed "Buddy Holly" and "Say It Ain"t So."

"Pinkerton," a second album based in part on "Madame Butterfly," may have killed the momentum, but it"s now remembered in some circles as the greatest Weezer album ever.

7 important issues Chipotle should discuss at its company-wide meetings on Feb. 8


How Chipotle made hundreds of people barf

All Chipotle locations will be closed for a few hours on the morning of Feb. 8 for an all-staff meeting, presumably to discuss new food-safety protocols after sickening hundreds of customers in incidents involving E. coli bacteria and a contagious norovirus.

But while theyre at it, there are many other important business matters that Chipotle execs should discuss with their employees. They follow here. Apologies if this extends the length of meetings for Chipotle workers who signed up to make burritos and not to waste all day in stupid meetings. Meetings are generally terrible.

1. Ingredient distribution

Improper ingredient distribution in burritos represents the biggest threat facing Chipotle right now. No, wait: Improper ingredient distribution in burritos represents the second-biggest threat facing Chipotle right now. Plenty of Chipotle burrito creators recognize the importance of evenly spreading out the ingredients inside a burrito, because no reasonable burrito-consumer wants a bite thats only sour cream and tortilla with no meat and salsa.

But Chipotles assembly-line format too often leaves the distribution of certain ingredients to ancillary workers who ignore the fine burrito craftsmanship of the person who started making the burrito. This needs to stop: Either assign one diligent Chipotle worker to craft the entire burrito, start to finish, or make sure every Chipotle worker is properly trained to slowly spread each ingredient over the length of the burrito instead of just dumping it all in one spot.

2. Limes

I cant speak for your local Chipotle, but my local Chipotle used to have both lemons and limes in a little container near the drink station and now it only has lemons. Limes are about 1,000 times better than lemons, which is crazy because lemons are pretty good. At the Chipotle all-staff meeting, Chipotle needs to discuss the limes, where they went, and how they can be safely returned to Chipotle restaurants without anyone accidentally covering them in a dangerous norovirus first. Pro tip: When life gives you lemons, demand limes.

3. Separating the peppers and onions

This ones personal: I love peppers, but I do not much care for onions especially not the slithery sauteed kind that comes in Chipotles fajita vegetables. In these trying times, Chipotle needs to prioritize its customers specific preferences above all else besides not hospitalizing its customers. My specific preference would be to get down on some of those delicious peppers without any onions spoiling the fun. Probably there are some people out there who like onions but not peppers, too. Theyre wrong, but they still deserve Chipotle catered to their specifications.

4. Banning food-guard offenders for life

If Chipotles trying to fix things that gross out its customers, it should take care to cut out the intense stomach pain, vomiting and diarrhea typical of E. coli infections. But then, after that, it should declare a zero-tolerance policy for people who put any part of their body over the food guard thats expressly designed to keep their filthy hands away from the delicious Chipotle stuff. The area behind the counter at Chipotle is sacred ground, and all who sully it must be banned from Chipotle for life. This extends all the way to the White House. No exceptions. Photograph everyone who violates the food guard and plaster every Chipotle with their pictures so they can be publicly shamed. And maybe come up with some lesser penalty for people who still say Chipol-tay. Cmon, bro, its 2016.

5. Burrito diplomacy with Minor League Baseball

Two things are true of most minor league baseball players: They dont get paid enough, and they love Chipotle. In an ideal world, Chipotle could work out some sort of deal with Major League Baseball wherein the league trades free advertising for free burritos to feed its minor leaguers, but in that same ideal world, Chipotle would not have had to close stores in nine states because of contaminated food. Any leverage Chipotle once had in this negotiation is gone now, but the company can go a long way toward restoring its image if it offers massive discounts to all minor league ballplayers. Theyre going to tweet about it, for sure, and presumably Chipotle wants people tweeting good things about Chipotle instead of things like, Hey baby! Are you Chipotle? Cuz you make me sick.

6. Meat variety

You know whats better than meat? Me neither. And the company might as well take this opportunity to introduce some new meats. For the Win proposes a rotating meat-of-the-month system, because this author would like to sample Chipotles versions of delicious meats like duck and bison and even good ol ground beef. Plus, itd be a great way to win back some customers scared off by the horrifying outbreak of illness that forced Chipotle to close stores in nine states.

7. Giving me free guacamole

This one is paramount: For Chipotle to ever again earn my trust, it needs to give me free guacamole. Maybe you, too, but first and foremost me. We made a deal, Chipotle: I give you money in exchange for delicious food under the understanding that my money is legal tender and your food wont leave me bedridden with extreme gastrointestinal issues. You broke the terms of our arrangement, and if you want back in my good graces, you better start with not charging me like two dollars for one scoop of guacamole on my burrito. Enough already.
