Dylan Noble"s father files claim against city over fatal Fresno shooting

Fresno police body camera video of Dylan Noble shooting

The attorney for the father of Dylan Noble has filed claims against the city on behalf of his client and the estate of Dylan Noble, saying Fresno police violated the 19-year-olds Fourth Amendment right to be free from excessive force when officers shot him four times in a gas station parking lot last month.

Attorney Warren Paboojian filed the claims Thursday. A claim is the precursor to a lawsuit and the city must now either accept or reject the claim.

The claim does not specify the amount sought for Nobles death, but Paboojian says the estate and his client, Darren Noble, are entitled to punitive damages and also asserted a survival claim for the loss or damage that Noble sustained or incurred before his death, including damages he would have been entitled to had he survived.

Paboojian says officers never tried to use anything other than lethal force when they confronted Noble during the June 25 traffic stop.

The officers never had an objectively reasonable basis to shoot Dylan Noble, Paboojian says. At no time did they use or attempt to use their K-9 unit. At no time did they use or attempt to use a TASER.

On Monday, attorney Stuart Chandler filed a similar claim against the city on behalf of Veronica Nelson, Nobles mother. Earlier this week, the City Attorneys Office said, Our policy is to refrain from discussing any pending claim or litigation.

Around 3:40 p.m. on June 25, Fresno police dispatch received a call from a woman who reported a man in a camouflage jacket walking around Clinton and Clovis avenues while carrying a rifle. Officers were in the area when they spotted Noble driving a pickup and initiated a traffic stop.

Paboojian acknowledges that after Noble pulled into the Chevron gas station, he got out of his vehicle, walked away from officers with his hands up and later turned and walked toward the officers. Paboojian also describes in the claim the succession of shots: two in rapid succession just over a minute after Noble stopped his truck, then another roughly 30 seconds later, while Noble was on the ground. Around 15 seconds later, a second officer fired a shotgun at Noble.

Paboojian notes in his claims that Noble did not resemble the man the officers were pursuing, and that Noble was not wearing any camouflage clothing.

Police Chief Jerry Dyer released the body camera footage from the shooting on Wednesday. The footage shows Noble ignoring the officers commands to show both of his hands and to stop moving his hands before he was shot.

At a news conference Wednesday evening at Paboojians northwest Fresno office, after Dyer spoke at police headquarters, Paboojian said the officers were needlessly aggressive from the outset.

I want to focus on one real important area, Paboojian said. This is a traffic stop. By no stretch of the imagination do we get (from) traffic stop to felony.

People are going to question Dylans conduct of why he did certain things, Paboojian said. The officers never gave Dylan an explanation or a chance to speak. The officers never, in those 30 commandments that Jerry Dyer indicated, did they ask him, Do you have a gun?

All they were doing was telling a young boy who may have been under the influence of some alcohol to do a bunch of commands for a routine traffic stop.

Dyer has said the two veteran officers feared for their safety when they encountered Noble. Also, Dyer said Noble did not follow officers orders and twice put a hand into his waistband, then withdrew it quickly. The officers thought he was reaching for a gun, and so they fired, the chief said.

Both officers are on paid leave while the shooting is investigated. No weapon was found on Noble.

The stars are supporting Jennifer Aniston"s open letter to the tabloids

Nia Vardalos: I Agree With Jennifer Aniston About Body Shaming | TODAY

Both male and female stars from around the world have spoken out to support Jennifer Aniston, after the actress published a powerful letter on Tuesday to call out the tabloids that stalk her. And were not at all surprised that everyones on Jennifers side. No one ever really thought that baby shaming and body shaming were ok now, did they?

Speaking on Entertainment Tonight, actress Melissa McCarthy said that she agrees with Jennifer one hundred thousand billion percent.

Everybody needs to stop tearing down women, she said, before explaining the difference in the ways that male and female celebrities are discussed in the media. Its always about the way we look saying, Hes very interesting, Hes a good writer, Shes looking older than she was last time we saw her. Its a ridiculous thing. I just hope it gets to the point where its embarrassing for people to have such a shallow thought.

Jennifers former co-star Jason Bateman simply wrote this kicks a*s while sharing the link on Twitter, and Jennifers husband Justin Theroux, posted this candid picture on Instagram, calling her his #WomanCrushWednesday.

Writer Piers Morgan meanwhile had a different opinion to share, calling Jennifer a hypocrite for sometimes choosing to appear in, and earn from, the media interest in her. If she really wants to make a difference to this ugly process, she can start by getting a tiny bit uglier herself and letting us see what she REALLY looks like on a magazine cover, Piers wrote. Then the little girls shes so worried about can know exactly what they are aspiring to be.

Female-kind neednt worry too much about Morgans comments, however, as Chrissy Teigen was quick to weigh in and have her say. @piersmorgan saw your piece on Jennifer Aniston. Why do you ALWAYS take the road of being the piece of st ahole? wrote Chrissy on Twitter. Particularly with women and people of colors. tell me its just for click?? Please tell me you arent TRULY this vile.

Lets hope Jennifers letter at least gets tabloid chiefs talking about what theyre running and who they really think its for.

Movie review: "The Infiltrator" features excellent Bryan Cranston performance

The Infiltrator Official Trailer #2 (2016) - Bryan Cranston, John Leguizamo Movie HD

Think of "The Infiltrator" as a thinking-man"s drug-cartel drama, filled with tension and carried by a Bryan Cranston performance so good that all should enjoy watching him fall on the right side of the law this time.

The actor known for his "Breaking Bad" meth-maker plays federal agent Robert Mazur, known for his undercover expertise in making drug busts and, in this true-story drama, how he went deeper than ever to infiltrate Pablo Escobar"s cocaine suppy to the U.S. in the 1980s.

Based on Mazur"s book, this crime biography is unique in the way that it balances the inherent deceptions in undercover work fooling crooks into doing things that will result in their imprisonment with how close the lawman-and-criminal relationship can become.

Including friendship and respect.

That"s an intriguing element to show, but also a hollow one when taking great pains to show how an Escobar lietenant is a "regular family man" who likes to cook for his wife and daughter without also showing such detail in how he orders murders and leaves other families" children as orphans.

But such flaws are few in this ensemble thriller with a unique filmmaking combination: It"s directed by Brad Furman of "The Lincoln Lawyer," with a screenplay adapted from Mazur"s book by Ellen Brown Furman the director"s mother.

They seem to have made a good team, and they created one on-screen as well.

Mazur (Cranston) is a by-the-book U.S. Customs agent known for his ethics and his in-depth planning and deep-cover identities, calling for odd clothing choices and hairstyles.

Mazur"s honesty and attention to detail in turning into "Bob Musella, money launderer to big-time drug dealers" can sometimes put him in odd situations with fellow agents.

Like the impulsive street-wise fed played by John Leguizamo, who enjoys wine and women, another element that the happily married Mazur takes no part in, even when it"s part of the job, or when a female agent is cast as his fiancee.

"National Treasure" actress Diane Kruger impresses in this rookie undercover role, working from a script that is so rich in character details and realistic dialogue that it allows many to stand out in the film, a real treat of this movie.

There are simply too many to name, and they"re not all big-name co-stars that create multi-dimensional bad guys, good guys and some who straddle the line in this Medillin Colombian cartel storyline.

Look for Yul Vasquez, appropriately flamboyant as a bisexual Escobar money-monitoring minion; Joseph Gilgun as a drug-runner that Mazur frees from prison to help keep the crew out of trouble; Art Malik as a crooked banker who cleans drug money; and about a dozen others.

Films rarely have this many small characters that are so memorable.

Then revel in the joys of Olympia Dukakis as Mazur"s aunt with an attitude; an out-of-nowhere Michael Pare as a doomed informant; and Benjamin Bratt and Elena Anaya, so good as the Escobar-confidante couple that Mazur and his "fiancee" befriend.

The tension created throughout all of this double-dealing makes it feel like something bad is about to happen, and more often than not, it does.

Ranging from loud blasts of action involving guns, knives and car crashes, to an "Escobar calling card" that arrives at Mazur"s home, there is considerable violence, but the film avoids being too graphic.

"The Infiltrator" is solid entertainment made even better by Cranston, who"s so dynamic, and yet subtle, in pulling off the roles of a good guy lawman, a bad guy drug criminal, a husband, a fiancee and above all a man who is committed to making a difference in the war on drugs in the 1980s.

Watching him play-act his way around a vicious criminal enterprise, while enduring occasional slip-ups and hoping they don"t get him and others killed, builds a case for "The Infiltrator" as a classy crime drama.

Jennifer Aniston is "fed up" with tabloids, rumors

Nia Vardalos: I Agree With Jennifer Aniston About Body Shaming | TODAY

USA TODAY , KSDK8:22 AM. CDT July 14, 2016

Jennifer Aniston (Getty)

Who has sold more tabloid magazines over the last fifteen yearsthanJennifer Aniston?

But after constantly being scrutinized post-lunch for a baby belly, with headlines declaring she"s "finally pregnant!" she"s had it.

The actress penned an essay for theHuffington Poston Tuesday, breaking her longtime stance of ignoring gossip chatter.

"Let me start by saying that addressing gossip is something I have never done. I dont like to give energy to the business of lies, but I wanted to participate in a larger conversation that has already begun and needs to continue," she wrote.

And just in case you were wondering, "for the record, I amnotpregnant," she says. "What I am isfedup.Im fed up with the sport-like scrutiny and body shaming that occurs daily under the guise of journalism, the First Amendment and celebrity news.

She starts by pointing out the public safety issues surrounding the constant presence of paparazzi following her and husbandJustin Theroux,44, but then widens the lens."I want to focus on the bigger picture of what this insane tabloid ritual represents to all of us," she says.Aniston, 47, realizes she is "some kind of symbol to people out there" and has connected the constant bump-watch forced upon herto a larger issue at hand.

"The way I am portrayed by the media is simply a reflection of how we see and portray women in general, measured against some warped standard of beauty," she says. "The message that girls are not pretty unless theyre incredibly thin, that theyre not worthy of our attention unless they look like a supermodel or an actress on the cover of a magazine is something were all willingly buying into."

This summer Aniston pregnancy rumors reached a new high, with tabloids volleying between showcasinga fictitious bumpon vacation toclaimingshe"s suddenly too thin (she waswearing boyfriend jeans).

In short, she can"t win.

"This past month in particular has illuminated for me how much we define a womans value based on her marital and maternal status," says Aniston, citing more pressingstories like mass shootings, Supreme Court decisions and the upcomingelection. "The sheer amount of resources being spent right now by press trying to simply uncover whether or not I am pregnant (for the bajillionth time... but whos counting) points to the perpetuation of this notion that women are somehow incomplete, unsuccessful, or unhappy if theyre not married with children," she writes.

Here"s Aniston"s truth, in her own words.

"Heres where I come out on this topic: we are complete with or without a mate, with or without a child. We get to decide for ourselves what is beautiful when it comes to our bodies. That decision is ours and ours alone. Lets make that decision for ourselves and for the young women in this world who look to us as examples. Lets make that decision consciously, outside of the tabloid noise. We dont need to be married or mothers to be complete. We get to determine our own happily ever after for ourselves."

For those wondering, she adds,"yes, I may become a mother some day, and since Im laying it all out there, if I ever do, I will be the first to let you know. But Im not in pursuit of motherhood because I feel incomplete in some way, as our celebrity news culture would lead us all to believe. I resent being made to feel less than because my body is changing and/or I had a burger for lunch and was photographed from a weird angle and therefore deemed one of two things: pregnant or fat.
